HSG Secures Unanimous Win at U.S. Supreme Court in Waetzig v. Halliburton Energy Services, Inc.
New York - On February 26, the Supreme Court of the United States ruled unanimously in favor of HSG’s client, the petitioner in Waetzig v. Halliburton Energy Services, Inc. HSG partner Vincent Levy argued the case in January.
In its ruling, the Supreme Court held that cases, which are voluntarily dismissed without prejudice under Federal Rule of Civil Procedure 41(a) are “final proceedings,” and thus may be reopened under Federal Rule 60(b). In doing so, the Court reversed the decision of the Tenth Circuit, which had created a circuit split. Justice Alito delivered the opinion of the Supreme Court.
